


TERMS & CONDITIONS
Effective Date: March 2025
These Terms and Conditions ("Agreement") are entered into between West Coast Boat Works, referred to as "the Company," and the customer, referred to as "Customer," for the purpose of providing boat repair and maintenance services. By engaging the Company’s services, the Customer agrees to be bound by these terms.
1. Scope of Services
The Company provides boat repair, maintenance, and related services. Specific services to be provided will be outlined in the service agreement or work order provided to the Customer before work begins.
2. Estimates and Pricing

All pricing is based on estimates provided prior to service. Estimates are subject to change based on unforeseen issues discovered during repairs or maintenance.

If additional repairs are necessary, the Company will seek approval from the Customer before proceeding with the work.

Prices for parts, labor, and services are provided separately. Any changes to the original estimate will be communicated to the Customer for approval.
3. Payment Terms

Payment is due upon completion of the repair or maintenance services, unless otherwise agreed upon in writing.

The Customer agrees to pay the agreed-upon price for all work performed, including any additional work authorized during the course of repairs.

The Company reserves the right that IF INVOICE EXCEEDS PASSED 5 DAYS OVERDUE FROM INVOICE DATE YOU WILL INCUR A LATE PAYMENT FEE OF $15. IF INVOICE REMAIN OVERDUE LONGER THEN 5 DAYS THE LATE FEE WILL INCREASE BY $1.50 PER DAY THAT THE INVOICE REMAINS UNPAID.
4. Customer Responsibility

The Customer must provide accurate and complete information about the boat's condition and history. Failure to do so may result in inaccurate estimates or delays in repairs.

It is the Customer’s responsibility to ensure that the boat is accessible and available for repair during agreed-upon times.

The Customer is responsible for removing any personal property or valuable items from the boat before repairs begin.
5. Repair Timeline

The Company will make reasonable efforts to complete repairs within the estimated timeframe. However, the timeline is subject to change depending on unforeseen complications, availability of parts, or weather conditions.

The Company is not liable for delays caused by circumstances beyond its control.
6. Warranty on Work and Parts
-
The Company warrants that all labor performed will be free from defects for a period of [X] months from the date of completion. If any defects are discovered during this time, the Company will repair or replace the defective work at no additional charge.

Parts used in repairs are subject to the manufacturer’s warranty, if applicable. The Company does not offer warranties on parts unless explicitly stated.
7. Liability and Risk

The Customer acknowledges that while the Company takes care in performing repairs, all boats have inherent risks associated with maintenance and repair work. The Company is not liable for any damage to the boat that occurs during repairs, except in cases of gross negligence.

The Customer agrees to hold the Company harmless for any injuries, damages, or losses arising from the repair process.
8. Cancellations and Modifications

The Customer may cancel or modify repair orders with at least [X] days' notice prior to the scheduled service. Any cancellation made after this period may result in a cancellation fee of [amount].

The Company reserves the right to cancel services in the event of extreme weather conditions, safety concerns, or unforeseen circumstances.
9. Ownership and Title

The Customer represents that they are the legal owner of the boat or have authorization to have repairs performed.

Any boats left with the Company for more than 5 days after notification of completion may be considered abandoned and subject to storage fees or other actions at the Company’s discretion.
10. Dispute Resolution
-
Any disputes arising out of or related to these terms and conditions shall be resolved through [mediation/arbitration] before a neutral third-party mediator/arbitrator. Any legal action shall be taken in the jurisdiction of Western Australia.
11. Governing Law
-
These terms and conditions are governed by the laws of the state of Western Australia, without regard to its conflict of laws principles.
12. Amendment
-
The Company reserves the right to modify or amend these Terms and Conditions at any time. Any changes will be communicated to the Customer prior to the commencement of services.
13. Privacy
The Company values Customer privacy and will not share or disclose personal information to third parties without consent, except as required by law.
